Foreign skilled employees must have a temporary offer of employment from a Canadian company and be given a Temporary Foreign Worker Permit by Human Resources and Skills Development Canada in order to work in Canada on a temporary basis.

Step 1: LMIAs (previously LMOs) (Labour Market Impact Assessments)

In most situations, you must first qualify for a Labour Market Impact Assessment (LMIA), formerly known as an LMO, from Service Canada before applying for a temporary Canadian Work Visa. A temporary tourist visa does not grant you the right to work in Canada.

What is the difference between LMOs and LMIAs?

The process for obtaining an LMIA is similar to that for obtaining an LMO, although there are some key changes.

  • Positions with a High Salary
  • The application forms have evolved from the previous LMOs and are now more comprehensive.
  • Employers must complete a “transition plan” outlining how they expect to permanently fill the job held by the temporary foreign worker; employers must retain more extensive records during the foreign worker’s stay in Canada; and individual applications will be processed more rapidly.
  • LMIA determinations will be made in 10 business days for skilled workers, high-paid workers with wages in the top 10% of Canadian earnings, and employees immigrating for 120 days or less.

LMIAs with Low Wages for Jobs in Canada for Immigrants

Low-wage LMIAs have a slightly different set of procedures and requirements than high-wage LMIAs. Low-wage employment offers are subject to more restrictions than high-wage job offers, as follows:

Employers will now be able to hire a foreign worker for only one year if they have a positive LMIA for low-wage jobs.

Low-wage foreign workers cannot make up more than 10% of the workforce in companies with more than ten employees.

Employers whose workforces do not comply with this rule will face transitional measures.

Companies in the hospitality and food service industries, as well as those in the retail trade, will no longer be able to apply for LMIAs for jobs in 10 lower-skill categories.

Canadian businesses must now pay a higher application cost, fill out longer application forms, and retain thorough records regarding their recruitment processes, just as high-wage LMIA applicants.

Who doesn’t need to fill out an LMIA application?

Employers in Canada can hire some TFWs without an LMIA, just like they could with the old LMOs. Temporary work permits are excluded from the LMIA in the following categories:

  • Under the NAFTA agreement, skilled workers are covered.
  • Transferees inside the company.
  • Participants in International Experience Canada (also known as Working Holiday Permit holders).
  • Holders of a post-graduate temporary work permit.
  • Holders of Open Work Permits are bridging the gap.
  • Postdoctoral fellows and visiting lecturers are examples of participants in private intellectual exchanges.
  • Programs like the ones listed above have been renamed ‘International Mobility Programs.’

Additionally, beginning in the summer of 2015, employers using some International Mobility Programs must have their employment offers authorized by a Canadian visa office before their recruited employees may apply for a temporary work permit in Canada. The employment offer approval application will cost $230 to process.

Step 2: The Temporary Job Offer is Extended by the Employer

CIC requires Canadian businesses to establish a formal employment contract, sometimes known as a “Job Offer Letter,” that must include the following information:

  • The position’s title is
  • description of the position
  • The requirements for the temporary position are as follows:
  • Dates for the start and end of the project
  • Details on the pay scale
  • The employer’s name and address

The Canada Service Agency will check to see if the job offer is genuine. Step 3: The Foreign Skilled Worker Submits a Work Permit Application

You can apply for a Canadian Temporary Work Permit once you have your LMIA and ‘Job Offer Letter’ in order. If your prospective employer is located in Quebec, you may be required to obtain a Certificat d’acceptation du Québec (CAQ) in order to work there temporarily. When applying for a temporary foreign worker permit, you may be required to meet with a visa officer for an interview.

A Canada Work Permit will be awarded if the visa officer is satisfied that the foreign worker’s employment will not have an unfavorable effect on Canadian employment and that the foreign worker qualifies for the post.

Note: that applicants from specific countries may be required to undertake medical checks in some situations.

Step 4: Obtain a Temporary Work Permit in Canada.

When the skilled foreign worker arrives in Canada, a Canada Border Services Agency (CBSA) officer will issue the Canadian Temporary Work Permit. In order to enter Canada, a Temporary Resident Visa (TRV) may be required, depending on the foreign worker’s country of citizenship. Obtaining a work visa requires a few more minor stages and procedures.
